These Terms of Service ("Terms") govern your access to and use of the Tailgate Sales Pro mobile application and website (the "Service") provided by Only Sky Artist, LLC ("Company," "we," "us," or "our"). By using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
Tailgate Sales Pro is a customer relationship management (CRM) tool designed for contractors and field service professionals. You may use the Service to manage business leads, schedule follow-ups, and track revenue goals.
You agree to use the Service only for lawful business purposes and in accordance with these Terms. You agree not to:
To use the Service, you must create an account with a valid email address and password. You are responsible for:
You must be at least 18 years of age to create an account and use the Service.
Free Trial: New accounts receive a 7-day free trial with full access to all features. No credit card is required to start a trial.
Paid Subscription: After the trial period, continued use requires a paid subscription at $49 per month (or the then-current rate). Payment is due at the start of each billing cycle.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial months.
Price Changes: We may change subscription pricing with 30 days' advance notice. Your continued use after a price change constitutes acceptance of the new rate.
Failed Payments: If a payment fails, we will notify you by email. Access may be suspended until payment is resolved. Your data will be retained for 90 days after suspension before permanent deletion.
You retain full ownership of all lead data, notes, and business information you enter into the Service. We do not claim any ownership rights over your data.
By using the Service, you grant us a limited, non-exclusive license to store and process your data solely for the purpose of providing the Service to you.
You are responsible for ensuring that any personal information you enter about third parties (such as homeowner contact information) is collected lawfully and with appropriate consent.
The Tailgate Sales Pro app, website, logo, design, and all related intellectual property are owned by Only Sky Artist, LLC. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our express written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any specific results will be achieved through use of the Service.
TO THE FULLEST EXTENT PERMITTED BY LAW, ONLY SKY ARTIST, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
You agree to indemnify, defend, and hold harmless Only Sky Artist, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of a third party.
We may suspend or terminate your account at any time if we believe you are violating these Terms or using the Service in a harmful way, with or without prior notice.
You may terminate your account at any time by deleting it through Settings → Delete Account. Upon deletion, all your data will be permanently removed.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Kendall County, Illinois.
We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and sending an in-app notification or email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
